The supermarket Morrisons Daily, North Street in Winchcombe was fined £4,000 for noise nuisance offences, Monday, 10 June 2024.

Tewkesbury Borough Council’s Environmental Health team received a complaint from a Winchcombe resident and served noise abatement notices on the 17 July 2023 and 11 August 2023.

Noise monitoring by the team during an extensive investigation proved noise from the condensing fans at the premises operated by the Daily Basket Ltd (trading as Morrisons Daily), was causing an excessive and persistent nuisance to local residents.

At Cheltenham Magistrates Court, the company was fined £4,000 for failing to comply with a noise abatement notice. They were also ordered to pay £935 costs to the council and a £1608 victim surcharge. The court also recognised the detrimental impact of the nuisance on the quality of life of the complainant and ordered the company to pay £6,000 compensation.

Peter Tonge, Director of Communities said: “We are very pleased with this result as it highlights the dedication and commitment of the environmental health team.

‘’We hope that this case will serve as a reminder that commercial premises have a legal obligation to conduct their operations in a responsible manner and without causing unreasonable nuisance and disruption to local communities.”
