Making the plan: 28 May 2019
At it’s Full Council meeting on the 28 May 2019, Tewkesbury Borough Council brought the Down Hatherley, Norton and Twigworth (Group) Neighbourhood Development Plan (NDP) into legal force, under Section 38A(4) of the Planning and Compulsory Purchase Act 2004.
The NDP now forms part of the statutory Development Plan for the Borough of Tewkesbury.
Referendum result
A neighbourhood planning referendum was held on Thursday 2 May 2019 to decide on the question below:
Do you want Tewkesbury Borough Council to use the Neighbourhood Plan for Down Hatherley, Norton & Twigworth to help it decide planning applications in the neighbourhood area?
The result was:
- Number cast in favour of a Yes = 395 (90.60%)
- Number cast in favour of a No = 35 (8.03%)
Referendum: 2 May 2019
A Referendum relating to the adoption of the Down Hatherley, Norton and Twigworth Neighbourhood Plan is to be held on Thursday 2 May 2019. The question being asked in the Referendum is:
“Do you want Tewkesbury Borough Council to use the Neighbourhood Plan for Down Hatherley, Norton and Twigworth to help it decide planning applications in the neighbourhood area?”

Next steps
Following the examination, and subject to the examiner’s report and the Borough Council’s legal checks, there will be a referendum held locally to decide whether to accept the Neighbourhood Development Plan. If successful at local referendum, the Neighbourhood Development Plan will then be put forward to Full Council for formal adoption to become part of the Council’s Local Development Plan.
Regulation 18 decision statement : January 2019
Following the examination of a neighbourhood plan the council is required to consider each of the examiner’s recommendations and decide what action to take in response to them. The council must also come to a formal view of whether the draft plan meets legal requirements including the Basic Conditions set out in legislation. This is set out in a decision statement. Down Hatherley, Norton and Twigworth’s Decision Statement is below:
Examiner’s report: September 2018
The Borough Council appointed Mr Robert Bryan (BA Hons, Dip TP, MRTPI) to undertake the examination of the Down Hatherley, Norton & Twigworth Neighbourhood Development Plan.
The examination is now completed and the examiner’s final report published. The report recommends that, subject to certain modifications, the neighbourhood plan can proceed to a referendum.
Examination: August 2018
The Borough Council has appointed Mr Robert Bryan (BA Hons, Dip TP, MRTPI) as the independent Examiner for the Down Hatherley, Norton & Twigworth Neighbourhood Development Plan. The examination will take place through August 2018.

Consultation: 23 April 2018
A consultation, under Regulation 16 of the Neighbourhood Planning (General) Regulations 2012 ran from 9 March 2018 until 23 April 2018. A report summarising the consultation responses plus the neighbourhood plan documents are below.

Submission: 02 February 2018
Down Hatherley, Norton and Twigworth Parish Councils submitted a joint Neighbourhood Development Plan, in accordance with Regulation 15 of the Neighbourhood Planning (General) Regulations 2012, to Tewkesbury Borough Council on the 2nd February 2018.
Neighbourhood area designation: 4 September 2013
The parishes of Down Hatherley, Norton and Twigworth applied to designate a joint neighbourhood area for the preparation of a neighbourhood development plan, which was validated on 17 June 2013. In accordance with the provisions of Regulation 5 of the Neighbourhood Planning (General) Regulations 2012, as amended a consultation on the proposed neighbourhood area was undertaken, ending on 26 July 2013. The meeting of the Executive Committee on 4 September 2013 resolved ‘That the designation of a neighbourhood plan area covering Down Hatherley, Norton and Twigworth Parishes be APPROVED.’
